In the aftermath of the Village of Iola denying a Conditional Use Permit (CUP) for a proposed sand/gravel mine, Faulks Bros. Construction of Waupaca will be refiling for a CUP for the Town of Scandinavia Iola Car Show properties.
According to what was explained at the recently Town of Scandinavia public hearing on the matter, Wisconsin Act 67 is restrictive on what can be denied by either the township or Waupaca County.
However, there may be additional conditions imposed by the township based upon concerns it has about the proposed operation than those delineated below for the Shady Drive mine.
In lieu of the fact that a CUP has been issued for a similar operation on Shady Drive, the township is not likely to be in a position to deny a CUP for this project.
The CUP between the township and MCC Inc. specifies these conditional uses:
Hours of operation will be 7 a.m.-6 p.m. Monday through Friday, 8 a.m.-noon Saturday. No Sundays or Holidays.
The route to/from the gravel pit is restricted.
No hauling of any kind during the Spring road limit season. This will be determined by the County Highway Dept schedule for county roads. The Town follows the same schedule.
Use of the pit is for extraction and trucking of material only. No crushing, processing or blasting allowed.
Hotmix/coldmix processing not allowed, but if desired in the future, it will be determined at a later date with a new application and public hearing.
If noise becomes a problem, MCC, Inc will work with Town officials and residents to mitigate issues.
MCC, Inc to establish a Point of Contact (POC) for both Town officials and residents of Shady Rd. to help mitigate issues, and address concerns with both the property to be mined, and ongoing road maintenance for Shady Rd.
